These online terms and conditions (“Online Terms”) apply when you access and use the digital channels of ABN Loans and Investments Pty Ltd, including our website, customer portals, mobile sites and applications, and any tools or services provided online (together, the “Digital Channels”).

In these Online Terms, “ABN Loans”, “we”, “us” and “our” refers to ABN Loans and Investments Pty Ltd and its related entities. “You”, “your” and “yours” refers to the person or business using the Digital Channels.

1. Acknowledgment & Acceptance

Each time you use the Digital Channels, you confirm your understanding and acceptance of these Online Terms.

These Online Terms apply in addition to:

- Any product-specific terms and conditions;

- Any agreement you enter into with ABN Loans;

- Our Privacy Policy.

If there is any inconsistency between these Online Terms and the terms of a product or agreement, the terms of that specific product or agreement will prevail.

2. User Obligations

By using the Digital Channels, you agree that you will:

- Not provide false, misleading or incomplete information, including in relation to your identity, financial circumstances, or your business;

- Ensure that your contact information is current and notify us of any changes;

- Only use the Digital Channels for lawful and intended purposes;

- Contact us immediately if you suspect your account has been compromised or there has been unauthorised access or use.

3. Use of the Digital Channels

Your access to and use of the Digital Channels may allow you to:

- Apply for finance or manage existing business loans;

- View current balances, repayment schedules and transaction history;

- Submit documents and communicate with us;

- Refer other businesses or partners (where applicable).

Not all products or services may be available in all jurisdictions or through all Digital Channels.

4. Intellectual Property

All content on the Digital Channels, including software, tools, text, images, logos and trademarks, is either owned by ABN Loans or used under licence. You must not reproduce, distribute, modify or use any of this content for commercial or public purposes without our prior written consent.

5. Security

5.1 You are responsible for maintaining the confidentiality of your login credentials, passwords and any access methods (“Access Methods”).

5.2 If you believe your account or device has been compromised, or if you detect any unauthorised transactions, you must notify us as soon as possible.

5.3 You are responsible for ensuring your devices are secure, including using appropriate anti-virus and software updates. ABN Loans is not liable for losses arising from the use of a compromised or jailbroken device.

6. Access and Availability

The Digital Channels are provided on an “as is” and “as available” basis. Access may occasionally be interrupted due to maintenance, upgrades, or factors outside our control.

You are responsible for ensuring you have contingency arrangements in place if you are unable to access your account digitally.

7. Authentication and Access

7.1 Depending on your access method, authentication may include:

- Email and password;

- SMS verification codes;

- Mobile app passcodes or biometric login (e.g., fingerprint or facial recognition).

7.2 You must ensure that only your own biometric data is stored on your device if you use it to access the Digital Channels.

7.3 We may use two-factor authentication (2FA) for certain activities. Standard carrier charges may apply for SMS codes.

8. No Advice

Information available through the Digital Channels is general in nature and does not constitute financial advice, an offer, or a binding agreement. Applications for finance are subject to our standard credit assessment and approval process.

You should obtain your own legal, financial or tax advice before relying on any information presented through our Digital Channels.

9. Privacy and Data

We may collect data about your use of the Digital Channels for the purposes of analysis, product development and service improvement. Your personal information will be handled in accordance with our Privacy Policy.

10. Suspension and Termination

We may suspend or terminate your access to the Digital Channels without notice if:

- We suspect fraudulent or unauthorised activity;

- You breach these Online Terms or any agreement with us;

- We are required to do so by law or regulator;

- Your account is inactive for six months or more.

Suspension or termination does not limit our rights under any loan agreement or law.

11. Limitation of Liability

To the extent permitted by law, ABN Loans is not liable for any loss, damage or cost arising from:

- The content or availability of the Digital Channels;

- Your use or inability to use the Digital Channels;

- Unauthorised access due to failure to keep your Access Methods secure;

- Network or service provider issues;

- Interruption, delay or downtime of the Digital Channels.

You agree to indemnify ABN Loans for any loss arising from your breach of these Online Terms or misuse of the Digital Channels.

12. Changes to These Terms

We may update these Online Terms from time to time. Changes will be posted on our website and may also be communicated via email or other electronic means. Your continued use of the Digital Channels constitutes your acceptance of any changes.

13. Governing Law

These Online Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of that state.
